Terms and conditions for using the Elder Thai website and booking in-home caregiving services.

These Terms of Use ("Terms") are a legal agreement between you and Biznitos Co., Ltd., operating as "Elder Thai" ("Elder Thai," "we," "us," or "our"), a company registered in Thailand with its registered address at Phra Khanong, Bangkok, Thailand 10260. These Terms govern your use of the website at elderthai.com (the "Site") and your booking or use of any caregiving, nursing-coordination, or related services we arrange or provide (the "Services").
By using the Site, submitting an inquiry, or booking Services, you agree to these Terms. If you do not agree, please do not use the Site or the Services. If you are booking or arranging care on behalf of another person (a parent, spouse, or other family member), you confirm that you are authorized to accept these Terms on that person's behalf and to make care decisions for them, or that you hold a valid power of attorney or equivalent legal authority to do so.
1. Who May Use the Site and Services
You must be at least 18 years old and have the legal capacity to enter into a binding contract to use the Site or book Services. The Services are intended for arranging care in Thailand only.
2. Description of Services
Elder Thai arranges bilingual, nurse-guided in-home caregiving support, including companionship, personal care, mobility assistance, medication reminders, post-hospital and post-surgical recovery support, dementia and memory care support, and related non-clinical services, with periodic oversight or check-ins by a nurse coordinator.
Elder Thai is not a hospital, clinic, ambulance service, or licensed medical treatment provider. Our caregivers and nurse coordinators do not diagnose medical conditions, prescribe medication, or replace the care of a licensed physician. Any nurse involvement is for guidance, monitoring, and coordination of the care plan, not for clinical treatment, unless separately agreed and permitted by applicable Thai law and professional licensing rules. Nothing on the Site or provided by our staff constitutes medical advice.
Elder Thai is not an emergency service. In a medical emergency, call 1669 (Thailand's national emergency medical number) or the nearest hospital immediately, and only afterward notify our office. We are not liable for delays or outcomes arising from a failure to contact emergency services directly.
3. Assessment, Care Plans, and Caregiver Matching
Before or shortly after care begins, we (or our nurse coordinator) will assess the care recipient's needs to propose a caregiver match and care plan. This assessment relies on the health, mobility, behavioral, and other information you and your family provide. You agree to give us complete, accurate, and timely information, including relevant medical history, medications, allergies, and behavioral risks (such as wandering, aggression, or fall risk), and to update us promptly if this information changes. We are not responsible for care outcomes that result from incomplete, outdated, or inaccurate information provided to us.
Care plans, hours, and the assigned caregiver may need to change based on the care recipient's condition, caregiver availability, or safety concerns identified by our team. We will make reasonable efforts to notify you of material changes in advance.
4. Bookings, Fees, and Payment
- Service rates, minimum booking periods, and start dates will be confirmed with you in writing (by email, LINE, WhatsApp, or a quotation) before Services begin.
- Invoices are issued by Biznitos Co., Ltd. and are subject to Thai value-added tax (VAT) and, where applicable, withholding tax, at the rates in force at the time of invoicing.
- Payment is due by the date stated on the invoice or quotation, by the payment methods we specify (such as bank transfer). Services may be paused or discontinued for accounts with overdue payment, after reasonable notice.
- Deposits, where required to confirm a booking or reserve a caregiver, are described at the time of booking and may be non-refundable if you cancel after a caregiver has been assigned or has begun preparing to start, except as required by law.
5. Cancellations, Changes, and Caregiver Replacement
We ask for as much advance notice as possible to change or cancel a scheduled booking, so we can reassign or stand down a caregiver. Late cancellations or no-shows at the home or hotel may be billed in full or in part, as agreed at booking.
If an assigned caregiver becomes unavailable (illness, resignation, or an unresolved match with the family), we will make reasonable efforts to arrange a suitable replacement promptly, but we cannot guarantee a specific replacement timeline in every circumstance, including force majeure events described in Section 13.
6. Your Responsibilities as a Client
You agree to:
- Provide a reasonably safe home, hotel, or condominium environment for the caregiver to work in;
- Disclose known risks in the home or from the care recipient that could affect the caregiver's safety (for example, aggressive behavior, firearms, or hazardous conditions);
- Ensure that any equipment you ask the caregiver to use (mobility aids, medical devices) is safe and in working order;
- Treat caregivers, nurse coordinators, and office staff with respect, and not request that they perform tasks outside the agreed care plan, unlicensed medical procedures, or unsafe or unlawful activities;
- Maintain any medical insurance or hospital arrangements needed for the care recipient; Elder Thai does not provide medical insurance.
We reserve the right to withdraw a caregiver, pause Services, or end an engagement if a caregiver's safety, dignity, or legal rights are at risk, or if these Terms are breached, with notice where reasonably possible.
7. Zero-Tolerance Sexual Harassment Policy
Elder Thai maintains a strict zero-tolerance policy toward sexual harassment and sexual misconduct directed at our caregivers. Prohibited conduct includes, without limitation:
- Unwanted touching or other unwelcome physical contact;
- Sexual comments, jokes, or requests;
- Sexual propositions or solicitations;
- Exposure of the body without a legitimate, care-related reason;
- Requests for sexual acts or otherwise inappropriate services; and
- Any other behavior that causes a caregiver to feel sexually threatened, harassed, or unsafe.
If a caregiver experiences sexual harassment, sexual misconduct, assault, or other serious inappropriate behavior from the client, a member of the client's household, or anyone else present at the place of care, the caregiver is authorized to leave the premises immediately for their own safety.
Where this occurs, Elder Thai reserves the right to terminate the service engagement immediately, without refund for any unused or remaining portion of the Services, and may decline to provide a replacement caregiver for that engagement. By booking or using Elder Thai's Services, you acknowledge this policy and agree that it applies to you and to any member of your household or other person present during a caregiver's visit.
8. Caregivers and Nurse Coordinators
Caregivers introduced through Elder Thai undergo a screening and matching process before placement. Caregivers may be engaged as our employees, or through partner agencies or independent arrangements, depending on the service; we remain your point of contact and coordination for the engagement either way. You agree not to engage a caregiver introduced to you through Elder Thai directly, bypassing our Services, for a period of 12 months after your last booking with us, except with our written consent. This protects the investment we make in recruiting, training, and supervising caregivers.
9. Communication Channels
We may communicate with you by phone, email, WhatsApp, or LINE for scheduling, invoicing, and care updates. Standard messaging and data rates from your provider may apply. These third-party platforms have their own terms and privacy practices, which we do not control.
10. Intellectual Property
The Site, including its text, design, graphics, and guides, is owned by or licensed to Biznitos Co., Ltd. and protected by copyright and other intellectual property laws. You may view and share Site content for personal, non-commercial use, but may not copy, republish, or use it commercially without our written permission.
11. Third-Party Links and Content
The Site may link to third-party websites, hospitals, insurers, or resources for your convenience. We do not control and are not responsible for the content, accuracy, or practices of third-party sites.
12. Limitation of Liability
To the fullest extent permitted by Thai law:
- Elder Thai's total liability arising from or related to the Services in any engagement is limited to the fees paid to us for that engagement in the three months preceding the event giving rise to the claim;
- We are not liable for indirect, incidental, or consequential damages, including loss of income or emotional distress, arising from the Services;
- We are not liable for the acts or omissions of third parties, including hospitals, doctors, pharmacies, insurers, or the care recipient's own family members or other household staff;
- Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under Thai law, including liability for death or personal injury caused by our proven gross negligence or willful misconduct.
13. Force Majeure
We are not liable for delay or failure to perform the Services due to events beyond our reasonable control, including natural disasters, pandemics, civil unrest, government restrictions, or transportation disruptions. We will notify you and work with you on reasonable alternatives where possible.
14. Complaints
If you are unhappy with any aspect of the Services, please contact us using the details in Section 18 as soon as possible so we can address it, including adjusting the care plan or, where appropriate, the caregiver assigned.
15. Termination
Either party may end an ongoing care arrangement with reasonable notice, as agreed at booking or as required for the safety of the caregiver or care recipient. Fees for Services already provided remain payable.
16. Governing Law and Disputes
These Terms are governed by the laws of Thailand. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the competent Thai courts in Bangkok.
17. Changes to These Terms
We may update these Terms from time to time to reflect changes in our Services or legal requirements. The "Last updated" date above shows when the Terms were last revised. Continued use of the Site or Services after changes take effect means you accept the updated Terms.
